Official U.S. Treaties
- What about treaties ratified after 1994?
- Until publication by the Department of State, they don’t have an official text for in-court purposes.
- You can make a FOIA request to the State Department’s Bureau of Treaties, or
- You can try to convince the court to accept as “best evidence” the quasi-official Senate documents (only “quasi” because they are the text to which advise and consent for ratification has been given, but they are not proof of actual ratification by the President
- I don’t know of any court who has ever refused this
